Subrogation Referral FAQs

When should I refer a subrogation claim?
Generally, the earlier the better. Early referral allows us to evaluate liability, identify evidence preservation needs (such as inspecting a failed product or vehicle before repair or disposal), and address any procedural deadlines that may apply to the claim.
What documentation do you need to evaluate a claim?
For most claims, helpful documentation includes the claim file and payment summary, photographs of the damage and, where applicable, the failed product or component, any incident reports, police reports, or witness statements, and policy information, including subrogation rights under the policy.
How long do I have to pursue a subrogation claim in Colorado?
Statutes of limitations vary depending on the type of claim (for example, claims based on negligence versus breach of contract may have different deadlines). Various factors could extend or reduce these times. Because these deadlines can affect recovery rights, we recommend referring claims as early as possible so we can evaluate timing issues.
What fee arrangements do you offer?
We offer flexible fee arrangements, including hourly billing, contingency fee arrangements, and hybrid structures, depending on the claim type, value, and the carrier's preferences. We're happy to discuss arrangements that work for individual claims or for an ongoing referral relationship.
Do you handle claims of all sizes?
Yes. While we've successfully resolved multi-million dollar claims, much of our subrogation practice involves smaller, high-volume claims, particularly auto property damage claims, handled efficiently to make pursuing recovery cost-effective.
Can you recommend experts for cause-and-origin investigations?
Yes. We maintain relationships with engineers, fire investigators, and other technical experts throughout the Denver area and can help identify the right expert for a given claim's specific issues.
