TRUST ADMINISTRATION & LITIGATION

When a trust becomes irrevocable, typically after the death of the person who created it, someone must step into the role of trustee and carry out its terms. Trust administration involves a number of legal and practical responsibilities, and trustees can face personal liability if those duties aren't handled correctly.

Beck, Payne, Frank & Piper, P.C. works with trustees, beneficiaries, and successor trustees throughout Colorado to administer trusts properly and resolve disputes when they arise.

Our Trust Administration Services Include:
  • Advising newly appointed trustees on their duties and responsibilities
  • Identifying, valuing, and managing trust assets
  • Preparing trust accountings for beneficiaries
  • Interpreting trust terms and resolving ambiguities
  • Distributing trust assets to beneficiaries
  • Advising on tax considerations related to trust administration
  • Representing trustees or beneficiaries in trust disputes and litigation

A Trustee's Duties
Serving as a trustee is a position of significant responsibility. Colorado law imposes fiduciary duties on trustees, including duties of loyalty, prudence, and impartiality among beneficiaries. We help trustees understand and fulfill these obligations, protecting both the trust's beneficiaries and the trustee personally from claims of mismanagement.

When Disputes Arise
Trust disputes can involve disagreements over how a trust is being managed, questions about a trustee's conduct, or disagreements among beneficiaries about distributions. We represent clients on both sides of these disputes, trustees seeking to defend their administration, and beneficiaries seeking accountability or clarity.
